Scaffold collapses and caused brain injury to contractor

Our client was performing construction work at a Greenville, Texas, church when the scaffold he was working on collapsed. Our client’s injuries were extensive. He had a fractured arms and cuts to his head. He was unconscious when the paramedics arrived and was life flighted from the scene.

Over the next months and years, our client received treatment for his orthopedic injuries and brain injury. He suffered issues with short term memory, headaches, and anxiety from the injuries and frustration. During those months and years, our injury attorneys fought against the contractors who allowed him to work on this dangerous scaffold which was put up in violation of basic OSHA standards (i.e., missing outriggers).

During litigation, our attorneys hired expert witnesses to explain what exactly had happened on the day our client fell and how it could have easily been prevented. We learned that the scaffolding used was meant to be set up with support arms called “outriggers,” and the contractors had not installed any of the necessary outriggers. The insurance company simply was trying to find a way to avoid coverage for the contractors.

Our injury lawyers showed up ready for trial inHunt County, Texas and argued pre-trial motions. A jury was empaneled, and jury selection was to begin Monday. After years of offering nothing on technical coverage grounds in bad faith, the insurance company finally relented when it became apparent that a large verdict was imminent.
