Parking lot wrongful death

Our client was tragically run over and killed by an employee at an auto repair shop. The auto repair shop did not have a waiting room large enough to accommodate its customers, and routinely had its customers wait outside the shop lobby, right next to the bay where vehicles were repaired.

There were no ropes, chains, warnings, or barricades which prevented customers from wandering behind vehicles that were being worked on.  Our client was run over by a mechanic backing out of the repair bay after the mechanic failed to ensure his path was clear and failed to announce that he was moving the vehicle.

Our client’s family sought out the Amaro Law Firm to find out what had happened to cause their beloved father and grandfather’s tragically preventable death.  The firm, through a data forensics expert, realized that video footage of the incident had been intentionally deleted by the auto shop.  However, our attorneys worked with the data expert to uncover fragments of video from the business next door to piece together how our client tragically passed.

Our firm brought a lawsuit against the property owner, the property manager, the auto shop, and the mechanic himself individually.

Further, through extensive discovery, our attorneys located a witness to the entire incident that the defendants had attempted to bury in their discovery responses.  After receiving the witness’ statement, we were able to negotiate a substantial confidential settlement with the property owner and manager who knowingly permitted this business to use a sidewalk as a driveway without protecting people using the sidewalk.
