Motor Vehicle Accident involving 18-Wheeler

In January of 2018 our clients, the driver and front-seat passenger of a Ford F-150, were rear-ended by an 18-wheeler on I-10 in Houston.  At that time, the commercial truck driver, who was recklessly driving the 18-wheeler commercial vehicle, failed to control the speed his speed, could not stop it in time, and slammed into the back of our clients’ vehicle.

Due to the impact, our clients suffered severe personal injuries, some of which required surgery.  The 18-wheeler driver’s actions went against all industry standards, training, and the Texas Commercial Driver’s License Handbook.  Professional truck drivers are responsible, among many duties, for operating their tractor-trailer at a safe speed, leaving plenty of space around their tractor-trailer for other vehicle, identifying hazards (such as traffic), and driving defensively.  The trucking company also has responsibility to ensure its driver knows these safety measures before putting someone behind the wheel of an 80,000 pound tractor-trailer.

During litigation, the Amaro Law Firm discovered multiple violations of the Federal Motor Carrier Safety Act, including the fact that the at-fault driver was unable to read or speak English in violation of Federal Law, and had an extensive criminal history which included tax evasion, stolen credit cards, and fraud. After a mediation of this case, our attorneys obtained a confidential settlement for both clients involved in this wreck.
